Question: The
Office of Juvenile Justice and Delinquency Prevention asked
us to query youth courts and find out which youth, teen,
peer, or student courts are handling bullying cases. Some of
the information they would like to know is:
- Does your

Hi, our
program does handle bullying issues. Our program is
community based since we work with the local justice court
and school based since we have a teen court at the school.
Our program deal with name-calling, threats, intimidation,
harassment, sexual harassment, racial issues etc. We have
only heard 1-2 cases in the past six years per year due to
the seriousness of the cases. The school usually wants to
handle these cases. The ages are 4th - 8th grades,
12-14yrs. old. Girls and boys are the gender. Community
service, counseling, letters of apology, essays.

The Illinois Valley Peer Jury only accepts those charged
with a crime. If the bully is charged with Assault or
Disorderly Conduct only then would we accept that youth into
the program and then deal with the underlying bullying
issue.

Does your program handle bullying cases? Unfortunately, only
once it becomes an assault and battery, not for the bullying
that occurs before hand.
Is your program a community-based or school-based youth,
teen, peer, or student court?
We are a community based (Boys & Girls Club) Teen Court
program.
What is the nature of the bullying incidents you see in teen
court (e.g., spreading rumors or facts about sexual
encounters, drugs and alcohol use, belittling a student who
is different because of physical appearance or handicap,
special education student, race and ethnicity, faith or
religion, etc.)? There are many incidents surrounding
sexual identity and homosexuality. There are also racial and
class (wealth) incidents.
The number of bullying cases heard over a year. Again, only
once it becomes assault and battery, we hear about 8 in a
year.
Typical age of offender, and victim (if known). Typical age
of offender, 16 and the victim is usually around the same
age.
Gender of offender and victim. Seems to always be male.
Typical sanctions for these offenses. Typical sanctions
include community service, anger management course, letters
of apology to victim or write a paper on the effects of
violence. We have also had some defendants attend a Human
Rights Commission meeting.

Lassen County Teen Court does not handle “bullying” cases as
such. All of our cases are referred to us from the district
attorney’s office or probation and are predominately
misdemeanors cited by either the police or sheriff. Any that
might have started out as bullying would be “fighting or
battery” cases for our program to hear them. If you need

We see many cases of bullying each year. We hear about 170
cases per year and I would estimate at least 90 or more
involve harassment and or bullying. Mainly they are charged
with battery or disorderly conduct, but upon speaking to
those involved we find out about bullying. Our program is a
community based program. Many incidents involve name
calling, harassment, verbal threats, instigating fights, and
peer pressure. The average age of offenders in our program
is 14, but I have seen harassment in kids as young as 10 and
as old as 17. For example, one 10 year old took a plastic
pellet gun to school tucked in his pants. When we asked why,
he said he wanted to scare the kid who had been bullying him
and his friends. We see this among both male and female
youth. Typically youth will receive sanctions including
community service, essays and or apology letters and jury
duty.

altercations but not "bullying" specifically stated.

of kids from each grade level.

Yes, we handle bullying, however they mostly come to us as
disorderly conducts.
Community Based program
The cases we see have started out with teasing and ended up
as a physical fight - so bullying (usually over a long
period of time) is the cause.
Not sure how many we see a year - probably about 10
Middle school (usually 6th grade)
We do the sticks n stones anti bullying program at our
schools and the youth need to be a part of that program,
plus the general apology letters, etc.....

which receives referrals from school administration and
school police officers. I classify us as community-based,
but all our referrals come from the schools.
What is the nature of the bullying incidents you see in teen
court (e.g., spreading rumors or facts about sexual
encounters, drugs and alcohol use, belittling a student who
is different because of physical appearance or handicap,
special education student, race and ethnicity, faith or
religion, etc.)? Some sexual harassment (without touching)
Belittling because of physical appearance (weight, physical
appearance, race, ethnicity, special education) We also see
assault and mutual fight cases which involve bullying
leading up to the incident.
The number of bullying cases heard over a year. 15-20
Typical age of offender, and victim (if known). 11 - 13 yrs
Gender of offender and victim. Sexual harassment - male to
female. All other bullying- offenders and victims are either
both male or both female (male to male and female to
female).
Typical sanctions for these offenses. Any combination of:
Conflict resolution/communication skills program for
parent/child together , community service,
individual and family therapy, apology letter, other life
skills or youth support group program.
Every youth receives a peer mentor (mentors are10th, 11th or
12th grade).

Our court, the Silverton/Mt. Angel Youth Peer Court in
Silverton, Oregon, does NOT handle bullying. Our court is
backed by a juvenile municipal court and the state
legislature decides which cases can or cannot be sent to
municipal court. They don't allow any offense with a
"violent" nature, which includes harassment, disorderly
conduct, carrying of a concealed weapon, etc..
Other peer courts in my county are not under this process
and receive their cases directly from the county juvenile
dept. They include Stayton, Keizer and Jefferson Peer
Courts. I hope you receive a response from them but if not,
let me know and I can help connect you with the
coordinators.

Peer Court Vermilion County Illinois covers the entire
county.
Within the last 16 months we handled a case where two girls
were picking on a third girl on the school bus. They were
calling her a dog and were throwing dog biscuits at her.
This was obviously planned out since the girls carried the
biscuits with them on the bus.
We handled this under Disorderly Conduct. Sentencing
Parameters: 20-50 Community Service hours, 1 or 2 different
nights of serving on jury, jail tour, write apology letters
victim/parents/bus driver, write essay on topic of
respecting others, mandatory participation in Jump Start
classes.
IN THIS CASE THE bus driver stopped the bus and called the
police. Had the police not been involved and made a charge
this case would likely not have been referred to Peer Court.
WE DO HANDLE battery cases in where we point out if the
victim or opposite offender is significantly younger than
the defendant. In this case prosecution often reminds the
court that this is a form of bullying.
We have not tried any cases with the offense being that the
defendant spreads rumors.
Peer Court Vermilion County Illinois does not have a charge
called bullying.

We have both school referrals and referrals from outside
courts. We have chosen not to take ANY bullying referrals
because we feel that in this instance, most of the teen/peer
jurors would be intimidated by the defendants because of
their actions. If the teen court volunteers are intimidated
by the defendants then no one benefits from the teen court
experience. We have not yet had any cases of this nature
from outside referrals (court-based) programs and would deal
with them on a case by case basis, but I would say that we
would probably not take these cases either for the same
reason mentioned above.

We do not handle this issue as “cases” but we do address it
in the juvenile justice unit we teach in the schools. This
year we also are having our court school students who are
out speaking in 4th, 5th, and 6th grade classes address
bullying. They talk about the different forms it takes and
read several stories—No One Knew What to Do, Little Ant for
example—as they talk with students how bullying can get them
in trouble.

Craven County Teen Court is a community based youth court
although 75% of the referrals do come from schools. We do
hear bullying cases (10 -15 per year) which we usually
classify as an assault ( verbal and physical attacks). Both
the bully and the victim are typically 6th or 7th grade (11
- 13) males. Typical sanctions that our youth juries assign
include: Community Service up to 8 hours, Teen Court Jury
Duty up to 5 cases, Juvenile Justice Education Class, Bully
Prevention Education Class, Anger Management/Conflict
Resolution Education Class, Letter of Apology to the victim,
and a 2 page Essay relating to the offense.

Our youth court has handled bullying cases. Our court is
community based. The cases have been cases dealing with race
(2), spreading of rumors (3), etc. We heard five cases out
of a case load of 36 in one year. All of the students have
been male and between the ages of 11-13. The sanctions were
letters of apology, a class with the counselor, community
service and improvement of grades or attendance.
This the Morgan Youth Court in Morgan, Utah. We have about
2100 students in our district evenly divided between the
three schools.

Okaloosa County Teen Court does not currently handle
“bullying” cases. The cases are given to us if an arrest is
made for battery or assault. We are currently working with
the School Resource Officers in our area to expand our
coverage and hope to soon handle school incidents that do
not lead to an arrest.

We run our Restorative Justice Initiative out of the Port
St. Lucie Police Department. Just last night we had a case
that involved bullying, however, the charge was battery. A
School resource officer arrested 3 12 yr old boys in 6th
grade for pushing a student they believed had told the
teacher on another student. The whole time they were pushing
and punching the boy, they were telling him he "better not
tell anyone." We addressed the bully aspects even though the
charge was battery. Each of the boys got an essay to write
on bullying. In this case the victim and his father were
members of the peer review panel. 2 of the 3 defendants were
brought to tears by the questioning. The victim felt sorry
for the defendants and told them he forgave them.
They all felt that they could one day be friends again. They
will all be brought together on March 30, as the 3
defendants were assigned jury duty as a Sanction, and the
victim also said he'd like to be on a jury.
Surely, this is the perfect picture of how Restorative
Justice is supposed to work.

The City of Elmira Youth Court does see bullying cases. The
Program is community based (Police Department) The nature of
the bullying cases has been: spreading of rumors;
teasing/belittling students who are handicap, different in
appearance and ethnicity, and special education students.
The majority of cases have been he said/she said this about
me… The number of bullying case has been approximately 60.
Typical age of offender and victim has been 12-14 years of
age. The gender has been mostly female, but we have had some
males. Typical sanctions for these offenses have been
community service, apology letters, and soon to be
educational classes.

Our school based court does handle bullying issues, and most
of these are spreading rumors, talking behind another
students back, and once in a while will be based on
ethnicity. We see approximately three cases per school year
and the students involved are of all high school ages. There
is no preference in gender, as we have seen both males and
females involved. For these types of cases, we get them
involved into student counseling at the school or some
mediation with an administrator. They will also be given
some school work crew.

Yes our court deals with many bullying cases - they can be
charged with harassment, assault or in some cases disorderly
conduct. We have had sexual and racial harassment cases,
pretty much the gamut of what has been listed. Our court is
a community based court. There has been an increase of cases
this year and on average we handle minimally one a month and
as many as 4 a month. The age ranges are 7th grade thru high
school - with many of the cases more typical of boys but
girls are gaining. Victims are the same profile. Sanctions -
some obvious ones are community work service and personal
apologies. We also do VOMP - victim offender mediation as
well as victim empathy classes.

school-based pre-k through 12. It is peer led.
