Juvenile Arrest Data
Question: We had
the following question sent to us by a youth court coordinator.
Please respond if you have information that will assist her.
In our jurisdiction, law enforcement officials keep data about
the number of juveniles arrested each year, and what their
offenses were. However, they do not keep data regarding of
those juveniles arrested, how many were first-time offenders.
And, to go one level deeper, how many of those first-time
offenders were eligible for diversion. Do any other
jurisdictions keep data on which arrests were first-time
offenders, and of those, how many were eligible for diversion?
If your jurisdiction does keep this data, what type of database
do you have and who is it accessible to? For example, in my
jurisdiction we have a comprehensive database that is a
collaborative partnership between the county and various law
enforcement agencies. This database is accessible to all law
enforcement agencies including probation. I wanted to know if
other jurisdictions have a similar situation.

In our jurisdiction only, I get copies of all minors who
have received tickets. Then from that group if they are of
a certain age, I send a notice making them aware of the
possibility of Teen Court, IF THEY MEET CERTAIN CRITERIA.
Then they are able to determine: if they are first time
offender, of certain age, willing to plead guilty/no
contest/ class C misdemeanor. Then they request the
diversionary program when they see the judge, if they see
benefits/advantages. There are both financial, educational,
and long term record benefits for choosing Teen Court so
most who are eligible, do request it.

DALLAS COUNTY TEXAS HAS A
JUVENILE DATA BASE THAT IS ACCESSABLE TO ALL AGENCY THAT ARE
IN THE CORPORATION. IT DOESN’T GIVE 1ST OFFENDER
INFO, BUT IF THEY ARE NO ENTRIES FOR THAT PERSON, WE ASSUME
THEY ARE 1ST OFFENDERS.

We have many
diversion program in our circuit. Teen Court is one of
many programs that take first time offenders. It would be
next to impossible for me to obtain the number of offenders
or the number of juveniles arrested- that would have to be
obtained from either the Juvenile Clerk's Office or he State
Attorney's Office.

Our
County (Erie) is in the process of collecting data for those
reasons right now. They have developed the software and are
collecting data from the law enforcement agencies in the
county. Once that is completed they will begin working on
Family Court and Probation. The last piece will be Child
Protection. Once all the data is compiled we will have a
complete background of the respondent and what steps were
taken to deal with the issues.

In our county all
non-traffic juvenile arrests are routed through juvenile
probation. The JPO maintains an extensive data base that
includes the number of arrests and what each was for on
every defendant. The JPO assigns diversion for all
misdemeanors and lower level felonies - he uses Youth Court
as the diversion process for first time offenders only.
